GDPR AND DATA PROTECTION RIGHTS (EEA & UK).
If you are located in the European Economic Area or the United Kingdom, you have specific rights regarding your personal data under the EU General Data Protection Regulation (GDPR). “Personal data” includes any information that can identify you or be linked to you, such as your IP address, mobile advertising identifier, or other information described in this Privacy Policy. We act as the data controller of your personal data for purposes of GDPR compliance. In accordance with the GDPR, you have the following rights over your data:
- Right of Access: You can request a copy of the personal data we hold about you, as well as information on how we use it.
- Right to Rectification: You have the right to ask us to correct any inaccurate or incomplete personal data we have on file.
- Right to Erasure (Right to be Forgotten): You can request that we delete your personal data when, for example, it is no longer needed for the purposes it was collected, or if you withdraw consent (where applicable). Please note this right is subject to certain exceptions (e.g., we may retain data if required by law).
- Right to Restrict Processing: You can ask us to limit the processing of your personal data in certain circumstances – for instance, if you contest the accuracy of the data or object to our processing.
- Right to Data Portability: You have the right to request that we provide your personal data in a structured, commonly used, and machine-readable format, and you may ask us to transmit it to another data controller where technically feasible.
- Right to Object: You may object to our processing of your personal data when we are relying on a legitimate interest (including profiling), or at any time if your data is being processed for direct marketing purposes. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue or as otherwise permitted by law.
- Right to Withdraw Consent: If we are processing your personal data based on your consent, you have the right to withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
To exercise any of these GDPR rights, please contact us at Support@Omnihome.app with your request. We will respond within the time frame required by law (generally within one month) and will honor your rights to the extent required by applicable law. For your security, we will take steps to verify your identity before fulfilling any requests. Also, please note that these rights may be subject to legal limitations; for example, we might retain certain information if we have a legal obligation to do so. In addition, you have the right to lodge a complaint with a supervisory authority in an EU member state or the UK if you believe that our processing of your personal data violates the GDPR.
CALIFORNIA PRIVACY RIGHTS (CCPA).
If you are a California resident, California law (including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act) provides you with specific rights regarding your personal information. In the past 12 months, we may have collected certain categories of personal information from or about you in connection with our Services, including identifiers (such as IP addresses and device advertising identifiers), Internet or other electronic network activity (such as your interactions with our app and ads), geolocation data (e.g. general location information or precise location if you allow it), and inferences drawn from the above to personalize your experience. We collect and use this personal information for the business purposes described in this Privacy Policy (for example, to provide and improve our services, to show relevant content or advertising, for security, and to communicate with you). We may share these categories of information with third-party service providers or partners for business purposes (such as analytics, ad delivery, or cloud services), as outlined in this Privacy Policy. We do not sell your personal information for monetary compensation. If we ever engage in data sharing that is considered a “sale” or “sharing” under California law (for instance, sharing certain identifiers with advertising partners), we will provide a means for you to opt out.
Your California Privacy Rights: California consumers have the following rights under the CCPA (and its amendments):
- Right to Know: You have the right to request that we disclose the personal information we have collected about you and how we have used and shared it. This includes the categories of personal information collected, the categories of sources, the business or commercial purposes for collection, the categories of third parties with whom we share personal information, and the specific pieces of personal information we hold about you.
- Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, we may retain information needed to complete a transaction you requested, to detect security incidents, for legal compliance, or other purposes permitted by law).
- Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you (taking into account the nature of the information and the purposes of processing).
- Right to Opt-Out of Sale or Sharing: You have the right to opt out of the “sale” of your personal information or the sharing of your personal information for cross-context behavioral advertising, as defined by California law. As noted above, we do not currently sell personal information. If this changes, we will update our Privacy Policy and honor any “Do Not Sell or Share My Info” requests, including signals transmitted through a browser’s Global Privacy Control (GPC) as applicable.
- Right to Limit Use of Sensitive Personal Information: If we collect sensitive personal information (as defined by law, e.g. precise geolocation or certain identifiers), you have the right to direct us to limit the use or disclosure of that information to those purposes allowed by the CCPA (as amended). We will only use sensitive information (if any) as necessary to provide the Services or as otherwise permitted by law.
- Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising any of your CCPA rights. This means we will not deny you our services, charge you a different price, or provide a different level of quality of service just because you exercised your rights under California law.
Exercising Your Rights: You (or your authorized agent) can exercise your California privacy rights by contacting us at Support@Omnihome.app. Please include “CCPA Request” in the subject line and let us know which right you wish to exercise (e.g., access, deletion, correction, opt-out). Once we receive your request, we will confirm receipt and may request additional information as needed to verify your identity and authority (for security, we need to ensure the request is coming from you or a person authorized to act on your behalf). We will respond to verified requests within the timeframe required by law (generally within 45 days, with an extension of an additional 45 days if reasonably necessary). If we cannot fulfill a request, in whole or in part, we will provide an explanation. Rest assured, per the Right to Non-Discrimination, we will not penalize you for exercising your rights. If you have any questions about your California privacy rights or how to exercise them, you can always contact us at Support@Omnihome.app.
